Brevo’s Terms name the US entity “SIB INC. US,” while its Privacy Policy calls the same entity “Sendinblue, Inc. dba Brevo USA” — a contradiction sitting inside its own legal pages. Card is the default payment method; ACH is open to US customers except for the first payment, and payment is due at signup, with no net-30 and no W-9 anywhere.
MailerLite accepts only card, PayPal, Przelewy24, or Shopify payment, ruling out cash and checks, priced in euros or US dollars by address. No non-card tier is published at any level: purchase stays self-service only, even on its highest published plan, past one hundred thousand subscribers.
MailerLite technically blocks a noncompliant send: the postal address and unsubscribe link can’t be removed, and a missing one triggers a hard error that stops the campaign, with no numeric deadline or state law published. Brevo instead patches the same gap, adding a default footer when the link is missing rather than blocking the send, while its Terms separately cite the TCPA and the CCPA — a sanction that stays contractual, never technical.
MailerLite runs on Google Cloud, in Germany and the Netherlands, under its own ISO/IEC 27001:2022 certification, with a stated Data Privacy Framework compliance; SOC 2, FedRAMP, StateRAMP, GovCloud, and a HIPAA BAA are all absent. Brevo runs on OVH, in France and Germany, and on Google Cloud, in Belgium, with ISO 27001:2022 as its only self-claimed certification — the same four regulated-cloud items missing on its side too, as of the seventh of September, twenty twenty-six.
MailerLite collects and remits sales tax on its own fees in sixteen states plus the District of Columbia, at a combined state-and-county rate calculated by zip code, bearing its own nexus determination. Brevo instead names twelve states outright — Florida, New York, and Texas among them — taxed at each state’s own rate. Neither vendor calculates the customer’s own downstream sales tax.
